Book description

The International Committee of the Red Cross's study of Customary International Humanitarian Law by Jean-Marie Henckaerts and Louise Doswald-Beck (Cambridge, 2005) contains a unique collection of evidence of the practice of States and non-State actors in the field of international humanitarian law, together with the authors' assessment of that practice and their compilation of rules of customary law based on that assessment. The study invites comment on its compilation of rules. Perspectives on the ICRC Study on Customary International Humanitarian Law results from a year-long examination of the study by a group of military lawyers, academics and practitioners, all with experience in international humanitarian law. The book discusses the study, its methodology and its rules and provides a critical analysis of them. It adds its own contribution to scholarship on the interpretation and application of international humanitarian law.

Select Frontmatter

Frontmatter
pp i-iv
Get access
Export citation

Select Contents

Contents
pp v-vi
Get access
Export citation

Select Preface

Preface
pp vii-x
Get access
Export citation

Select List of contributors

List of contributors
pp xi-xii
Get access
Export citation

Select Table of cases

Table of cases
pp xiii-xxi
Get access
Export citation

Select Table of treaties and other instruments

Table of treaties and other instruments
pp xxii-xxviii
Get access
Export citation

Select Abbreviations

Abbreviations
pp xxix-xxxii
Get access
Export citation

Select Part 1 - Setting the scene: Theoretical perspectives on international law in the ICRC Study

Part 1 - Setting the scene: Theoretical perspectives on international law in the ICRC Study
pp 1-2
Get access
Export citation

Select 1 - The methodological framework of the Study

1 - The methodological framework of the Study
pp 3-14
By Daniel Bethlehem
Get access
Export citation

Select 2 - The approach to customary international law in the Study

2 - The approach to customary international law in the Study
pp 15-49
By Iain Scobbie
Get access
Export citation

Select 3 - Other areas of customary law in relation to the Study

3 - Other areas of customary law in relation to the Study
pp 50-74
By Françoise Hampson
Get access
Export citation

Select Part 2 - The status of conflict and combatants: The ICRC Study

Part 2 - The status of conflict and combatants: The ICRC Study
pp 75-76
Get access
Export citation

Select 4 - Status of armed conflicts

4 - Status of armed conflicts
pp 77-100
By Jelena Pejić
Get access
Export citation

Select 5 - Combatant status

5 - Combatant status
pp 101-128
By Anthony Rogers
Get access
Export citation

Select Part 3 - Commentary on selected Rules from the ICRC Study

Part 3 - Commentary on selected Rules from the ICRC Study
pp 129-130
Get access
Export citation

Select 6 - The law of targeting

6 - The law of targeting
pp 131-168
By Michael N.
